  1  4 TO REQUIRE INSURERS OFFERING CERTAIN INDIVIDUAL OR GROUP HEALTH
  1  5    INSURANCE CONTRACTS, POLICIES, OR PLANS TO PROVIDE COVERAGE
  1  6    FOR VACCINATIONS FOR HUMAN PAPILLOMA VIRUS.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1 10    Section 1.  NEW SECTION.  514C.23  HUMAN PAPILLOMA VIRUS
  1 11 VACCINATIONS == COVERAGE.
  1 12    1.  Notwithstanding the uniformity of treatment
  1 13 requirements of section 514C.6, a contract, policy, or plan
  1 14 providing for third=party payment or prepayment of health or
  1 15 medical expenses that provides coverage benefits for any
  1 16 vaccination or immunization shall provide coverage benefits
  1 17 for a vaccination for human papilloma virus, including but not
  1 18 limited to the following classes of third=party payment
  1 19 provider contracts, policies, or plans delivered, issued for
  1 20 delivery, continued, or renewed in this state on or after
  1 21 January 1, 2009:
  1 22    a.  Individual or group accident and sickness insurance
  1 23 providing coverage on an expense=incurred basis.
  1 24    b.  An individual or group hospital or medical service
  1 25 contract issued pursuant to chapter 509, 514, or 514A.
  1 26    c.  An individual or group health maintenance organization
  1 27 contract regulated under chapter 514B.
  1 28    d.  An individual or group Medicare supplemental policy,
  1 29 unless coverage pursuant to such policy is preempted by
  1 30 federal law.
  1 31    e.  A plan established pursuant to chapter 509A for public
  1 32 employees.
  1 33    2.  This section shall not apply to accident only,
  1 34 specified disease, short=term hospital or medical, hospital
  1 35 confinement indemnity, credit, dental, vision, long=term care,
  2  1 basic hospital and medical=surgical expense coverage as
  2  2 defined by the commissioner, disability income insurance
  2  3 coverage, coverage issued as a supplement to liability
  2  4 insurance, workers' compensation or similar insurance, or
  2  5 automobile medical payment insurance.
  2  6    3.  As used in this section, "human papilloma virus" means
  2  7 the human papilloma virus as defined by the centers for
  2  8 disease control and prevention of the United States department
  2  9 of health and human services.
  2 10    4.  The commissioner of insurance shall adopt rules
  2 11 pursuant to chapter 17A as necessary to administer this
  2 12 section.
