House File 478 - Enrolled PAG LIN 1 1 HOUSE FILE 478 1 2 1 3 AN ACT 1 4 RELATING TO THE IOWA COMMISSION ON VOLUNTEER SERVICE. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. NEW SECTION. 15H.1 FINDINGS. 1 9 The general assembly finds: 1 10 1. There is a compelling need for more civic participation 1 11 to solve community and state problems, and to address many of 1 12 the country's unmet social, environmental, educational, and 1 13 public safety needs. 1 14 2. Promoting the capability of Iowa's people, communities, 1 15 and enterprises to work collaboratively is vital to the long= 1 16 term prosperity of this state. 1 17 3. Building and encouraging community services and 1 18 volunteerism is an integral part of the state's future well= 1 19 being, and requires cooperative efforts by the public and 1 20 private sectors. 1 21 4. The development of a volunteer service program in Iowa 1 22 requires an administrative vehicle which conforms with federal 1 23 guidelines detailed in the federal National and Community 1 24 Service Trust Act of 1993. 1 25 Sec. 2. NEW SECTION. 15H.2 IOWA COMMISSION ON VOLUNTEER 1 26 SERVICE ESTABLISHED. 1 27 1. The governor shall establish the Iowa commission on 1 28 volunteer service which shall be part of the governor's 1 29 office. The governor shall appoint the commission's members. 1 30 2. The mission of the commission is to advise and assist 1 31 in the development and implementation of a comprehensive, 1 32 statewide plan for promoting volunteer involvement and citizen 1 33 participation in Iowa, as well as to serve as the state's 1 34 liaison to national and state organizations which support the 1 35 commission's mission. 2 1 3. The commission shall do all of the following: 2 2 a. Prepare a three=year national service plan as called 2 3 for under the federal National and Community Service Trust Act 2 4 of 1993. 2 5 b. Fulfill federal program administration requirements, 2 6 including provision of health care and child care for program 2 7 participants. 2 8 c. Submit annual state applications for federal funding of 2 9 commission=selected AmeriCorps programs. 2 10 d. Integrate AmeriCorps programs, the corporation for 2 11 national and community service program, and the older American 2 12 volunteer program into the state strategic service plan. 2 13 e. Conduct local outreach to develop a comprehensive and 2 14 inclusive state service plan and coordinate with existing 2 15 programs in order to prevent unnecessary competition for 2 16 private sources of funding. 2 17 f. Provide technical assistance to service programs, 2 18 including the development of training methods and curriculum 2 19 materials. 2 20 g. Develop a statewide recruitment and placement system 2 21 for individuals interested in community service opportunities. 2 22 h. Prepare quarterly reports on progress for submission to 2 23 the governor and the general assembly. 2 24 i. Administer the retired and senior volunteer program. 2 25 Sec. 3. NEW SECTION. 15H.3 VOLUNTEER SERVICE COMMISSION 2 26 MEMBERSHIP. 2 27 1. The Iowa commission on volunteer service shall consist 2 28 of the following members: 2 29 a. An individual with expertise in the educational 2 30 training and developmental needs of youth. 2 31 b. An individual with experience in promoting the 2 32 involvement of older adults in service and volunteerism. 2 33 c. A representative of community=based agencies within the 2 34 state. 2 35 d. The director of the department of education, or the 3 1 director's designee. 3 2 e. The executive secretary of the state board of regents, 3 3 or the executive secretary's designee. 3 4 f. A representative of local government. 3 5 g. A representative of a local labor organization. 3 6 h. A representative of a for=profit business. 3 7 i. An individual between the ages of sixteen and twenty= 3 8 five who is or has been a participant or supervisor in a 3 9 volunteer or service program. 3 10 j. A representative of the corporation for national and 3 11 community service who shall serve as a nonvoting, ex officio 3 12 member. 3 13 2. No more than twenty=five percent of the commission 3 14 members shall be employees of the state, though additional 3 15 state agency representatives may sit on the commission as 3 16 nonvoting, ex officio members. 3 17 3. A commission member shall not vote on issues affecting 3 18 organizations for which the member has served as a staff 3 19 person or as a volunteer at any time during the preceding 3 20 twelve=month period. 3 21 4. The membership of the commission shall comply with 3 22 sections 69.16 and 69.16A. The membership of the commission 3 23 shall also reflect the diversity of the state's population. 3 24 5. Members shall serve staggered terms of three years 3 25 beginning and ending as provided by section 69.19. Members of 3 26 the commission shall serve no more than two three=year terms. 3 27 Any vacancy shall be filled in the same manner as the original 3 28 appointment. 3 29 6. The chairperson of the commission shall be selected by 3 30 the governor and serve at the governor's discretion. 3 31 Sec. 4. NEW SECTION. 15H.4 ADMINISTRATION == FUNDING. 3 32 1. The governor's office shall serve as the lead agency 3 33 for administration of the commission. The department of 3 34 education, the state board of regents, the department of 3 35 workforce development, and the department of economic 4 1 development shall provide additional administrative support as 4 2 necessary to fulfill the duties of the commission. All other 4 3 state agencies shall provide assistance to the commission to 4 4 ensure a fully coordinated state effort for promoting national 4 5 and community service. 4 6 2. The commission may accept funds and in=kind services 4 7 from other state, federal, and private entities. 4 8 Sec. 5. Section 231.23A, subsection 3, Code 2005, is 4 9 amended by striking the subsection. 4 10 Sec. 6. Section 231.55, Code 2005, is repealed. 4 11 4 12 4 13 4 14 CHRISTOPHER C.
